Do I need a post accident drug test?
When is DOT and Non-DOT Post Accident drug testing required?
The Federal Motor Carrier Safety Administration (FMCSA) requires DOT post-accident drug testing in specific situations. The following information provides a clear overview of when testing is mandatory:
Fatality Accident
DOT Post-Accident drug and alcohol testing is always required in the event of a fatality. In the unfortunate result of a fatality from the accident, a post-accident drug and alcohol test will be required.
Bodily Injury Accident
In the event of a bodily injury accident that requires immediate medical treatment away from the scene, alcohol testing is required if a moving violation citation is issued within 8 hours. A drug test is required if a violation is issued within 32 hours.
Tow-Away Accident
In the event of an accident that requires towing to any motor vehicle, and a citation is issued to a CMV driver within 8 hours, an alcohol test is required. If a citation is issued within 32 hours of the occurrence, a drug test is required. If there are no citations issued, then a DOT test is not required.
